These Terms and Conditions (“Terms”) govern your access to and use of the Eckankar San Jose website located at https://www.eckankarsanjose.cloud (the “Website”).
The Website is operated by Eckankar San Jose, a local center/program of the California Satsang Society, Inc. In these Terms, “Eckankar San Jose,” “we,” “us,” and “our” refer to Eckankar San Jose and, where applicable, the California Satsang Society, Inc.
By creating an account, logging in to, accessing, or using the Website, you agree to these Terms and to the Eckankar San Jose Privacy Policy. If you do not agree, do not create an account, access, or use the Website.
If you provide a telephone number and opt in to receive text messages through the Website or in connection with class-related activities, you also agree to the SMS/Text Messaging terms in Section 11 below.
The Website is a private, members-only class-management and communication resource. It is intended to help coordinate classes between authorized Eckankar class teachers and current Eckankar members who apply for, are admitted to, or participate in those classes.
Access is available only to current members of Eckankar who complete the Website’s membership-verification process and create an account. The Website is not open to the general public.

To help limit Website access to current Eckankar members, Eckankar San Jose uses a periodically updated membership-verification process. The verification process may use a credential made available to eligible current members through an authorized membership publication or other authorized communication.
Membership-verification credentials, account-creation access codes, and access authorizations may be changed, revoked, or invalidated periodically, generally after a new quarterly issue of The Mystic World is published. If access is reauthorized periodically, you must complete the then-current membership-verification process to continue using the Website.
You must not disclose, share, transfer, publish, distribute, sell, provide, or otherwise enable another person to use:
Eckankar San Jose may deny, suspend, restrict, or revoke Website access if it reasonably determines that you are not a current Eckankar member, have shared or misused access credentials, provided inaccurate registration information, attempted to bypass verification or security measures, or used the Website contrary to these Terms.
After completing the applicable membership-verification process, you may create an individual Website account without prior administrator approval. Account creation does not itself grant teacher status, class admission, or any authority beyond the access made available to you through the Website.
You must create and maintain an individual password for your account. Your password is personal to you and may not be shared with anyone else. You are responsible for:
You may not create an account for another person, use another person’s account, impersonate another person, or attempt to obtain or use credentials that do not belong to you.
The Website contains nonpublic class-management information. Such information may include class titles, schedules, availability, enrollment or admission status, teacher assignments, and the names of members associated with a class.

Teacher access is available only to individuals who have been expressly authorized as teachers by an Eckankar San Jose administrator.
Teacher status is separate from ordinary member account access. Eckankar San Jose may grant, modify, limit, suspend, or revoke teacher access at any time as necessary to administer the Website, protect member information, or maintain the proper operation of class-management activities.
A teacher may use student email addresses and telephone numbers visible through the Website solely for legitimate communications concerning class applications, admission decisions, scheduling, availability, meeting reminders, and related class activities. Teachers must not use such information for unrelated purposes or disclose it to unauthorized persons.
You agree not to use, or attempt to use, the Website in a way that could harm the Website, its users, Eckankar San Jose, the California Satsang Society, Inc., or any other person. You must not:
Subject to these Terms, Eckankar San Jose gives you a limited, personal, nonexclusive, nontransferable, non-sublicensable, revocable license to access and use the Website solely for its intended, noncommercial class-management purposes.
No ownership interest in the Website, its software, design, functionality, database, text, data, compilation, logos, trademarks, or other content is transferred to you. All rights not expressly granted are reserved by Eckankar San Jose, the California Satsang Society, Inc., and their respective licensors or rights holders.
You may not reproduce, modify, distribute, display, sell, lease, sublicense, exploit, or create derivative works from any Website material except as expressly permitted in writing by Eckankar San Jose.
Your use of the Website is also governed by the Eckankar San Jose Privacy Policy, which describes the personal information collected through the Website, how it is used and protected, when it may be shared, and the choices and rights available to you.
The Privacy Policy is incorporated into these Terms by reference. By using the Website, you acknowledge that class-related information and communications may be processed as described in the Privacy Policy.
By creating an account or submitting a class-related request through the Website, you agree that Eckankar San Jose and authorized teachers may communicate with you by email, telephone, or text message for Website-related purposes, including:
Eckankar San Jose does not use the Website to send unsolicited marketing communications. If you wish to update your contact information or have questions about communications, contact the Class Coordinator using the contact information below.
Text-message communications are optional unless otherwise clearly stated when you provide your telephone number. You may opt out of future text messages at any time as described in Section 11.
Eckankar San Jose may offer an optional SMS/text-message program for current Eckankar members who choose to provide a mobile telephone number and opt in to receive text messages.
If you opt in, you may receive text messages related only to authorized Website and class-management activities, including:
Eckankar San Jose does not use this text-message program to send promotional, commercial, fundraising, or unsolicited marketing messages.
By voluntarily providing your mobile telephone number and opting in to text-message communications, you consent to receive recurring SMS or MMS messages from Eckankar San Jose and, where appropriate, authorized class teachers acting on behalf of Eckankar San Jose.
Your consent to receive text messages is not a condition of creating a Website account, applying for a class, being admitted to a class, or using the Website. You may receive class-related communications by email or telephone where appropriate.
You represent that you are the account holder for, or otherwise have authorization to use, the mobile telephone number you provide.
Message frequency varies based on your class participation, class availability, pending applications, admission status, schedule changes, and meeting reminders.
You should expect to receive messages only when reasonably necessary for Website-related or class-related communications. The number of messages may vary from month to month and may increase temporarily when a class is beginning, a schedule changes, or action is required regarding an application or admission decision.
You may cancel SMS/text-message communications at any time by replying STOP to any text message you receive from Eckankar San Jose.
After you send the SMS message “STOP,” we will send you one SMS message confirming that you have been unsubscribed. After that confirmation, you will no longer receive SMS messages from us unless you later opt in again.
If you wish to rejoin the SMS/text-message program after opting out, you may sign up again through the Website or otherwise provide a new opt-in as instructed by Eckankar San Jose.
Your request to stop text messages applies to the applicable telephone number. Opting out of text messages does not automatically close your Website account, withdraw a class application, remove you from a class, or stop email or telephone communications that may be reasonably necessary for class-management purposes.

Message and data rates may apply to messages sent to you from us and to us from you. Your wireless carrier may charge you according to the terms of your mobile service plan.

Wireless carriers are not liable for delayed or undelivered messages.
Delivery of text messages depends on factors outside our control, including your wireless carrier, network availability, mobile device, signal strength, and service interruptions. We do not guarantee that text messages will be delivered, received, or read at a particular time.
Information collected or processed in connection with the SMS/text-message program, including your telephone number, opt-in status, opt-out request, and class-related communications, is governed by the Eckankar San Jose Privacy Policy.

Eckankar San Jose may modify, suspend, discontinue, or restrict all or any part of the Website at any time, with or without notice, including Website features, available classes, account access, access codes, verification procedures, user permissions, and SMS/text-message communications.
We may suspend or terminate your account or access immediately if we reasonably believe that:
You may stop using the Website at any time. You may request deletion of your account or correction or deletion of your personal information to the extent required by law by contacting the Class Coordinator.
Ending your access does not end obligations that, by their nature, should continue, including confidentiality, intellectual-property restrictions, limitations of liability, indemnification, and dispute-related provisions.
The Website, including any SMS/text-message communications made available through or in connection with the Website, is provided on an “as is” and “as available” basis.
To the fullest extent permitted by applicable law, Eckankar San Jose and the California Satsang Society, Inc. disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, availability, accuracy, reliability, security, and uninterrupted or error-free operation.
We do not guarantee that:
You are responsible for using reasonable safeguards, including maintaining current device security and backups where appropriate.
To the fullest extent permitted by law, Eckankar San Jose, the California Satsang Society, Inc., their officers, directors, employees, volunteers, authorized leaders, teachers, agents, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data; loss of goodwill; loss of opportunity; delayed or undelivered communications; or damages arising from or related to your use of, inability to use, or reliance on the Website, SMS/text-message program, or related information.
To the fullest extent permitted by law, the total aggregate liability of Eckankar San Jose and the California Satsang Society, Inc. for all claims arising out of or related to the Website, SMS/text-message program, or these Terms will not exceed ten U.S. dollars (US $10).

These Terms and any dispute arising out of or relating to the Website, the SMS/text-message program, or these Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
Except where applicable law requires otherwise, you and Eckankar San Jose agree that any lawsuit, claim, or proceeding arising from or related to the Website, SMS/text-message program, or these Terms must be brought exclusively in the state or federal courts located in Santa Clara County, California. You consent to the personal jurisdiction and venue of those courts.
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
Our failure to enforce any provision of these Terms is not a waiver of that provision or of our right to enforce it later.
You may not assign or transfer your rights or obligations under these Terms without prior written permission from Eckankar San Jose. Eckankar San Jose may assign these Terms in connection with the administration, reorganization, or transfer of Website operations.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Eckankar San Jose concerning the Website and supersede prior discussions or understandings concerning the Website.
